Welcome to 1MindDesign. By accessing or using our website and services, you agree to be bound by these Terms of Use. Please read them carefully before proceeding.

1. Services

1MindDesign provides website design, development, hosting, maintenance, digital marketing, AI automation, and related services on a subscription basis. We reserve the right to modify, suspend, or discontinue any services at any time.

2. User Responsibilities

By using our services, you agree to:

• Provide necessary content, branding assets, and approvals within 14 days to avoid project delays or termination.

• Ensure any content submitted does not infringe on intellectual property rights or violate any laws.

• Maintain your own compliance with relevant legal and industry regulations (e.g., ADA, GDPR, CCPA). 1MindDesign provides tools but does not guarantee compliance.

3. Subscription & Payment Terms

• Subscriptions auto-renew unless canceled at least 14 days before the next billing cycle.

• Refund Policy: Setup fees, design work, and AI/automation services are strictly non-refundable. No partial refunds for early cancellation.

• Buyout Option: Clients may migrate their website by paying a buyout fee, which excludes premium software licenses (e.g., Elementor Pro, AI tools). Clients must purchase their own licenses for continued use.

4. Intellectual Property & Licensing

• All website designs, code, AI-generated content, and assets remain the property of 1MindDesign until full payment is received.

• Clients do not own premium software licenses included in our services. Upon buyout, clients must purchase their own.

• Any user-submitted content remains the property of the user, but by submitting it, you grant 1MindDesign a non-exclusive license to use, modify, and display it as necessary for the service provided.

5. AI & Automation Disclaimer

• AI-generated content (e.g., chatbots, automated marketing, workflow automation) may not be 100% accurate. 1MindDesign is not responsible for errors, misinterpretations, or compliance issues related to AI services.

• AI automation relies on third-party integrations (e.g., GoHighLevel, WPMU DEV), and 1MindDesign is not liable for service interruptions, data loss, or third-party failures.

6. Limitation of Liability

To the maximum extent permitted by law, 1MindDesign shall not be liable for:

• Any direct, indirect, incidental, special, or consequential damages arising from the use of our website or services.

• Loss of revenue, data, or reputation due to service downtime, AI-generated content, or third-party failures.

• Any security breaches, hacks, or malware issues that arise from client negligence (e.g., weak passwords, outdated plugins).

7. Termination of Services

1MindDesign reserves the right to terminate your access to services with or without cause or notice if:

• You violate these Terms of Use.

• Your subscription payment fails after multiple attempts.

• You engage in any fraudulent, abusive, or unlawful activity.

8. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Prince George’s County, Maryland, USA.

9. Modification of Terms

1MindDesign reserves the right to modify these Terms of Use at any time. Continued use of our services after modifications constitutes acceptance of the updated terms.

By using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you should not use our website or services.
